Lotus FM, the lies....

Some newspapers recently reported a growth in listenership and revenue for Lotus FM.

Those newspapers were mislead. In a meeting last night with Acting GCEO, he has confirmed that both revenue and listenership for Lotus FM has gone down, not up as Ms. Samuels told one newspaper.

Revenue from April 2009 to August 2009 decreased by 12%.
Listenership from August 2008 to August 2009 decreased by 54 000 listeners,

Not good news for advertisers. The effect of the poor management of the station is starting to show clearly now.

So we losing listeners AND revenue, and Top Management is doing... what????

SABC Board not serious about fruitless & wastefull expenditure

The SABC Board is not serious about the ongoing fruitless and wasteful expenditure at the SABC.

We have seen NO action at all taken against managers involved in some of the most serious cases of fruitless and wasteful expenditure. This lack of action demonstrates a general absence of political will by the Board to do what is legally required of them as the responsible governing body of the SABC. By not taking any action at all, alternatively by ignoring the legislated action required by the PFMA, naturally means that the Board condones the fruitless and wasteful expenditure, and consequently aligns itself with same.

For instance, the Durban 4 (0r 5 when we add Shereldene Hamman) case has resulted in fruitless and wasteful expenditure according to latest very reliable information of R8 Million Rand. One case about 6 employees that did not steal a cent from the SABC, or attempted to steal a cent from the SABC. They merely tendered for old, obsolete vehicles which the SABC wanted to get rid off. In the first round of tenders, one employee won the tender on 7 vehicles. Legally, rightfully and honestly. So did Zakes Dube, Nokothula Luthuli and all the witnesses testified. Luthuli and Dube did not like this, and decided to unilaterally and unlawfully change the Policy in respect of the number of vehicles an employee may buy. He called it "empowerment" which he explained to be that he wanted every employee to have the opportunity to buy a vehicle. In other words, no sound financial principles where the highest bidder will win, and the SABC makes maximum profit on the vehicles, which naturally means the more you get for your old vehicles, the less (public, and therefore TV Licence) money you have to spent on new vehicles. In any event, his warped mathematics and logic did not make any sense at all, for more than one reason. There were much more employees than vehicles. Also, in other regions no limit whatsoever were put on the number of vehicles a single person could buy.

So Dube and Luthuli then decided to take back the vehicles that the one employee legally, rightfully and honestly won by tender, and they issued a rule that has never existed before, which does not appear in the Tender Policy and which was unlawful, unreasonable but most of all financially stupid. The rule that each employee may only tender for one vehicle.

This rule was never applied to other people, as most employees went ahead and tendered for more than one vehicle. The six employees tendered for vehicles, they were successful and they all sold their vehicles on for a small profit. They were then charged and it was alleged that they tendered on behalf of the one employee. So no dishonesty, no fraud, no misrepresentation and most importantly, no loss of any money to the SABC as a result of their actions, but rather several thousands of loss due to Dube and Luthuli's decision to re-auction the vehicles, and it was sold for less in the second tender.

And then the SABC's hangmen then moved in. Khoma, Ralitabo and their cronies. 4 Employees were dismissed, and 1 were, and still is on full paid suspension. 3 Years on full paid suspension, even after we have won the case at the CCMA!

At best these employees should have been called in and reprimanded.

Just as an example how unfair the SABC conducts their hearings, and why we have no faith and trust in the internal hearings, as we believe the outcome is pre-determined, it came out during the arbitration that the panel discussed and already decided to dismiss the employees even before evidence in mitigation was presented.

How did we know this?

They accidentally left on their own tape recorder and it was transcribed and handed in as part of the record of the disciplinary hearing! We have all the documentation to support everything said here and the tapes.

So what else did the SABC do to these poor employees, their First Citizens?

They were arrested without a warrant, appeared in Court once, and for three years thereafter never again. So the R8 Million Rand is not all, lawsuits may follow for the false charges pressed against the employees, which could result in a further R 6 Million or more cost to the SABC. So who arrested them? The policeman of Organised Crime who himself was arrested for corruption who has admitted that his wife and Luthuli are close friends! It goes without saying the case against the policeman was swept under the carpet.

Also Hamman and Ramiah's salaries were suspended. It resulted in Hamman losing her property and being blacklisted at the credit bureau. So more civil lawsuits to be come against the SABC, pushing up the cost of this case to possibly R15 M. Surely the SABC must give back Hamman's property that she has lost due to their illegal actions. We say illegal actions, as we shortly after she has lost her property, we brought an urgent application to have their salaries re-instated, which we have won with costs.

Al of this said, each and every one involved in this matter who worked with Dube and Luthuli to cause this fruitless and wastefull expenditure of a definite R 8M and a possible R15 M are still employed by the SABC and they are still on a daily basis involved in doing this to their employees too.

How ever can any Board overlook this kind of expenditure without asking any questions, without taking any action and without putting any measures in place to prevent same?

We are seeing a repetition of this going to happen at Lotus FM, where the program manager has been unfairly and unprocedurally suspended. Again in KZN, again Dube, Luthuli and Khabo from HR involved. Same people, different victim. We see Ntenteni and Soko defending these actions. We on our way to the CCMA with an unfair suspension. Will the hearing follow, and will the same executioners also dismiss the program manager, Beharie? We don't know. Looks like it.

What we know is we will in the same manner continue to defend and protect our members rights.

What we also know is that to condone the wastage of R8 Million on one case can never go unnoticed by a responsible Board.

KPA's vs ADD

Just a reminder that the dispute between BEMAWU and the SABC has not been resolved in respect of KPA's.

ADD is the only agreed to and accepted performance management system for BEMAWU members.

BEMAWU members must therefore insist on ADD and not agree to KPA.

LEAVE

BEMAWU this morning had an impromptu meeting with the CPO and acting COO where the issue of leave was discussed.

The CPO confirmed that the Chairperson of the Board's directive about the taking of leave is only applicable to employees who does not have it as a condition of employment that they can accumulate leave. In other words this is not applicable to you as a member of BEMAWU.

We are/were in the process of bringing a semi-urgent application to stop the SABC forcing our members to take leave and I was requested by the CPO to hold back for the moment as the matter will be re-looked at by Exco.

Again, please do not take your accumulated leave unless it exceeds 90 days (new pool only), as is stipulated in the Leave Policy. You cannot forfeit it.

UPDATE

Based on questions received by members, the following clarification:

In terms of the Leave Policy, (which is a stipulated and undisputed term and condition of emplyment) you are allowed to have as many days as you have accumulated - in other words, uncapped - leave in respect of the old pool. In terms of the "Accumalative leave" you are only allowed to accumulate 90 days.

This is an example:

Time AccountDeductible fromDeductible toEntitlementRemainder
Accumulative Leave 27.58 Days 13.83 Days
Encashable Leave 74.08 Days 54.08 Days
Sick leave 185.00 Days 180.00 Days
Compulsory Leave1/1/20096/30/2010 12.25 Days 0.00 Days
Old Leave Pool Days1/1/200712/31/9999 70.42 Days 70.42 Days

This employee are entitled to accumulate leave in the first column only up to 90 days. So no leave needs to be taken here.

This employee is entitled to encash 74 days leave.

In respect of the last column, this employee has accumulated 70 days of leave. There is no capping of leave for this category. So no need to take any leave in this category, even if it was 300 days.

Lotus FM Strike suspended

The strike at Lotus FM has been suspended until Wednesday, 26 August pending a possible resolution of the matter.

Durban 4 back

The SABC has just confirmed that our members in the Durban 4 case can start working on 1 September. This brings an end to a 3 year long battle for fairness and justice where these employees were subjected to unprecedented harassment, ranging from unlawful arrests by a policemen arrested for corruption himself to unfair suspension and humiliation. This case incurred legal cost to the SABC of nearly 6 million rand in legal cost.
This is what BEMAWU does for our members on a daily basis - protecting you from high handed management.

Viva to the power of trade unions!

Subject: Lotus Strike

All full time BEMAWU members at Lotus FM are currently on strike.

The reason for the strike is actually very simple. Employees at the station are unhappy with the manner in which the station has been managed. There is a total breakdown in the trust relationship between the employees and the manager.

In the employer/employee relationship Management have most of the time most of the power. They have the right to dismiss and appoint, to discipline and to instruct. Employees only have power when they collectively stand together when they are unhappy and embark on industrial action.

The only recourse employees have to remove an abusive manager from office is to go on strike. Particularly when such a manager is protected by Top and Senior Management.

BEMAWU members are fighting various principles with this strike. One being the right to come to work and not being exposed to abusive management and management not making sound financial decisions.

We cannot allow a situation where we have unhappy workers and we have no recourse

We request that all employees, and in particular BEMAWU members participate in the strike today, even if it is only in your lunch time. If we do not fight this bad management practices, it may happen to you tomorrow, where a managers simply makes a decision to dismiss you.

Please show solidarity and support for our comrades outside. Today, between 12:00 and 13:00.

Viva!

LEAVE

Please take note that the instruction from the Interim Board that BEMAWU members must take their accumulated leave or forfeit it, is unlawful and an unilateral change to terms an conditions of employment.

BEMAWU will proceed with legal action against the SABC to protect the rights of our members.

PLEASE DO NOT TAKE YOUR ACCUMULATED LEAVE. YOU CANNOT FORFEIT IT!

Message to Lotus FM Listeners and Advertisers

Dear Loyal Listener,

Lotus FM full time staff will go on strike tomorrow, 19 August 2009 until further notice. The strike is being organised by BEMAWU, the Broadcasting, Electronic, Media and Allied Workers Union, the union almost all Lotus employees belong to.

Staff are unhappy about the following :

  • The fact that the station manager, Ms Gail Samuels gave away a substantial amount of airtime for free, which contributed to the SABC’s massive deficit, and only received a written warning with no civil action against her to recover the fruitless and wasteful expenditure, whilst other SABC employees have been dismissed for less serious offences.
  • The fact that the station manager makes decisions that is financially and otherwise not good for the continued existence of the station, like taking the uncles Peru and Bala off-air, for no apparent business and/or economic reason.
  • double standards of top and senior management of the SABC when it comes to the station manager of Lotus FM.
  • The unfair suspension of the program manager, Santosh Beharie on bogus allegations, and as intimidation and victimisation tactics.

It is not our intention to inconvenience listeners, but we have to save the station. Almost 90% of full time staff at Lotus have requested the SABC to lawfully redeploy Samuel's to another position, (there is currently a suitable position available for her) and to put someone in charge of the station that understands broadcasting and the audiences and who is trusted by the staff. Management have refused to do so as the station manager is protected by Top and Senior Management for some undisclosed reason. We have also demanded that her disciplinary hearing be reviewed by an independent 3rd party. SABC management has refused. Why? Is it because they know they are protecting the station manager and that she was supposed to be dismissed as a result of the serious allegations against her?

Staff are currently very demoralised and their working conditions are unbearable under the management of Samuels.

  • We fear that the station’s future may be in jeopardy if it continues to loose advertisers and listeners. As loyal listeners to Lotus FM, we kindly request your support as we go on strike tomorrow for the immediate removal of Ms. Samuels. We request to, in solidarity to save the station from further bad management and fruitless and wasteful expenditure to do the following:
  • To electronically put a vote of no confidence in the station manager by voting on our blog at http://bemawu.blogspot.com
  • To stop listening to the station for a period of 2 days initially, being tomorrow, the 19th of August and Thursday, the 20th of August.
  • To send this e-mail to every other listener you know and convince them to do the same,
  • To convince all advertisers to withhold their advertising until our demand is met that the station manager be redeployed,
  • To demand that uncles Peru and Bala be put back on air.

The effect of you not listening to the station will result in advertisers not reaching their target audiences, thereby wasting their money to advertise. They will then automatically withdraw their advertising until everything is back to normal, being when Samuels is redeployed.

SABC KZN suspends Lotus FM program manager unfairly

The SABC in KZN has today unfairly suspended our member, the Lotus FM program manager Mr Santosh Beharie on bogus allegations.

Mr. Beharie were requested to forward reasons why he should not be suspended on allegations of undeclared business interests, disruption of relations, leaking of confidential information and dereliction of duties.

When asked to provide details of the allegations, Liketso Mokokoane the Acting General Manager of PBS Radio instead served our member with a suspension letter. We don't know what our member has been suspended for and an unfair suspension dispute will be filed tomorrow morning at the CCMA.

We view this as severe victimisation
The Station Manager, Gail Samuels was accused of giving away thousands of rands worth of airtime but never was suspended. Our member is now suspended on bogus charges that does not even warrant suspension, even if it had substance.

Can the Board PLEASE get rid of this INCOMPETENT management? The previous case of the Durban 4 resulted in legal cost of close to R 6M Rand, and the employees in question were reinstated. How much of license money will be spent on this case?

How does any organization allow the spending of almost R6M on one case and no action is taken against such management?

Leave

We have received some remarks and concerns about the recent unlawful announcement in respect of the taking of leave.

Not the Board or Human Resources can force you to take accumulated leave. You can NEVER in the circumstances forfeit accumulated leave. Please do not take your accumulated leave based on the threat that you will forfeit it.

We are still waiting for the SABC to respond to our letter in respect of the leave issue.
